RUSH: We have a legal decision on sanctuary cities, and it’s a good one. A three-judge panel on the Second Circuit Court of Appeals unanimously overturned a district court judge who ruled the Trump Administration could not withhold grants from sanctuary cities. That was part of the anti-Trump “Resistance” movement amongst the judiciary.

In 2017, then-Attorney General Jeff Sessions announced the Department of Justice was going to withhold grant money from states who defied federal immigration law by granting “sanctuary” to illegals.

It didn’t take long for the Resistance to act. Seven states – New York, New Jersey, Connecticut, Virginia, New Jersey, Rhode Island, Massachusetts, and Washington state – ran to federal court and sued. And as so often happens, coincidentally, the Resistance states found a friendly Resistance district judge to go along with them. The Trump Administration appealed.

So now, finally, we’ve gotten a common sense ruling from the Appellate court. They ruled that of course the federal government can withhold grant money from states who break federal law. It’s a no-brainer!

This will probably end up at the Supreme Court because liberals never give up the fight, no matter how ridiculous or absurd it may be. But, at least for now, you can file this under: “We’re not tired of winning.” And victory is so sweet.
