RUSH: Now, this next story’s a fabulous story, and it’s not getting a lot of play, precisely because it’s a fabulous story. “A federal judge,” and this is a big-time leftist judge, “upheld the Bush administration’s new terrorism law Wednesday, agreeing that [Club Gitmo] detainees do not have the right to challenge their imprisonment in United States courts. The ruling by US district Judge James Robertson…” and this guy is a big lib. I think he’s a Clinton appointee. “The ruling by US district Judge James Robertson rejects a legal challenge by Salim Ahmed Hamdan, a former driver for Osama bin Laden, whose case prompted the Supreme Court to strike down the Bush administration’s policy on detainees last year.
“Following that ruling Bush pushed for and got a new law that established military commissions, the tribunals, to try enemy combatants and stripped them of the right to seek their freedom in US courts.” So the judge, his hands were tied. He had no choice. He said Congress passed a law clearly intending to keep such cases as Hamdan’s out of federal courts, and because of that, he, the judge, no longer has jurisdiction to hear it. “The ruling is a legal victory for the Bush administration,” which, it says here, “has been fending off criticism of the new law from Democrats and civil libertarians.” Nah-nah-nah-nah-nah-nah. Too bad. You lost one and finally the US courts are at least out of one element of the war on terror.
