TODD: Of course, they\u2019re gonna try to pack the courts — or are they? So there\u2019s legislation that would change — would adds seats to — the Supreme Court to make it so that there would never be ever again any form of originalism. That\u2019s a confusing word, isn\u2019t it? Originalism, we know on this program, but for new people — \u2019cause this show is growing.<\/p>\n

We have news about this later in the program. The show is growing! (laughing) Rush\u2019s image continues. The originalism is this: Are we going to have people on the court who actually look at words on paper and say, “Yeah, that words means ‘city;\u2019 that word means ‘state.'” I\u2019m not joking. John Roberts pretends — has pretended — that Washington, D.C., is one of the many states. He literally pretended that.<\/p>\n

\"\"So this effort to expanded the courts is to pack it with what? With whom? With people who don\u2019t care what the words on paper say. “The right of the people to keep and bear arms shall not be infringed.” Well, that could mean… You\u2019ve got arms. I\u2019m looking at you. Look, you got nice wings. The suns are out, the guns out. Your biceps. Those are arms. You\u2019re bearing them.<\/p>\n

Weasel words with words are infamous. It\u2019s infamy. It might be — and there\u2019s a great article on Fox News about this. It might be that this effort is actually just a threat. This is Kelsey Koberg at Fox News.<\/a> It might be that this is just a threat to these sitting justices. “Hey, you can go ahead and read the Constitution and such,” Not that they do a lot of that, but sometimes they do.<\/p>\n

“But they\u2019ll just make you obsolete. We\u2019ll just pack the court with people who don\u2019t care what the words of the Constitution say.” I try to communicate this to people — like, people who are new to politics or new to governance. Here\u2019s an example. You could be playing a football game. It\u2019s 7-6. Let\u2019s make it better. It\u2019s 6-nothing. You score a touchdown and an extra point, and then the referee comes along goes, “Well, I mean, let\u2019s admit it. Pfft! That kick didn\u2019t go right through the middle. So let\u2019s call that half a point.”<\/p>\n

They could do that.<\/p>\n

“Well, but the words…”<\/p>\n

“We don\u2019t care.”<\/p>\n

So, to me, I think this makes a lot of sense that it\u2019s just a threat. You go away, you\u2019ll still be justices, you\u2019ll still have some power, just not the powers that were granted you by the Constitution and by being appointed to the Supreme Court. We\u2019ll take those from you, or we can just do what we want 90% of the time. Now, Rush talked about originalists in this clip here<\/a>, clip number 8. He described this as arrogant losers who act like winners.<\/p>\n

RUSH: Activist judges are judges that don\u2019t interpret the Constitution. Activist judges are judges that actually don\u2019t want there to be a Constitution. If we\u2019re going to have activist judges, folks, we don\u2019t need a Constitution. It\u2019s just like if we\u2019re going to let anybody in the country that wants in, we don\u2019t have a country. We may as well not have a border. If we\u2019re not going to enforce the border, we don\u2019t have a country. Well, if we\u2019re going to have judges that will not look to the Constitution, we don\u2019t have a Constitution, and that\u2019s what we get with activist judges.<\/p>\n

We get activist judges who take their personal policy preferences to the bench, and then they decide cases on the basis of those personal policy preferences and they call that “law.” So their personal policy preferences become constitutional. Well, they\u2019re not. You can say something is constitutional all you want but it is only constitutional if it is. If it\u2019s not constitutional, it\u2019s not — and these are, you know, not matters of debate.<\/p>\n

That\u2019s why originalist is a key word. You go back; you look at the original intent. You can find it. It\u2019s there. Federalist Papers, numerous discussions, the document itself. The Fifth Amendment to the Constitution is clear, but the US Supreme Court said, “Ah, we think it means something else.” So now we have a bunch of states and the US Congress thinking of writing a law that basically says what the Constitution already says.<\/p>\n

\"\"So we\u2019re having to rewrite the Constitution because we\u2019ve got a bunch of judges who are ignoring it, plain and simple. That\u2019s the definition of an activist judge.<\/p>\n

TODD: And it also works this way. Like, understand the danger of this, it can\u2019t be overstated. There\u2019s a lot to be concerned about in our country. It also works like this. That can be pulled over by a cop… Well, let\u2019s just go to this. Just across the border in Canada, they have people coming to our border with the SOS sign in Morse code.<\/p>\n

Just this past weekend, they\u2019ve announced that police now have some new, unusual powers. In Canada, they can now stop you and say, “Why did you leave your house? Why?” Now, we have limits on that in our country, but when you toss the rules out and a cop can pull you over for what? “Why am I being pulled over?”<\/p>\n

“Pfft. Red shirt? I don\u2019t know. I felt like it.”<\/p>\n
