RUSH: Look, folks, I know where you\u2019re coming from, I know how frustrated you are, I know how you want heads to roll. I\u2019m the same. This judge, Emmet Sullivan, what he\u2019s trying to do to Flynn. I\u2019ll tell you exactly what he\u2019s trying to do to Flynn. He\u2019s trying to prolong this and engineer this. You know, Flynn has pled guilty. Judge Sullivan is gonna pronounce sentence on that. He is gonna sentence him to jail because of Flynn\u2019s guilty plea.<\/p>\n

“But, Rush, but, Rush, he can\u2019t do that, he can\u2019t do this friend of the court amicus stuff because Supreme Court –” He\u2019s gonna do whatever he wants. He\u2019s gonna force a pardon from Trump. That\u2019s what this is. He is not gonna let Flynn get away with the DOJ dropping the case. He\u2019s gonna do everything they can to sentence Flynn based on Flynn\u2019s original plea that he withdrew, that he had lied to the FBI.<\/p>\n
Now, we know why Flynn entered the plea. They were ruining him and they were then promising to ruin his son, like they did to Manafort. Like they tried on Roger Stone. Like they tried to K.T. McFarland. But I think they\u2019re trying to prolong this because some people even think that the judge, Emmet Sullivan, is trying to extend this case for months in the hope that Trump is not reelected, that a Democrat is elected, like Plugs. You gotta a new attorney general in there, you got effectively a new the Department of Justice and they withdraw their withdrawal of the case and they reimplement the case on Flynn.<\/p>\n
These people — folks, I\u2019m gonna tell you what is happening here – there are so many different ways to look at this, and there are a lot of people with theories, but I think somebody is scared to death what Michael Flynn knows. I don\u2019t pretend to know what it is, don\u2019t misunderstand. I think somebody is scared to death what Michael Flynn would say, might say, could say. I think there is an all-out effort to intimidate Flynn into just shutting up. Whatever goes down from here on forward, he stands mute, he says nothing. And I think these people that are scared to death of what he knows and what he might say are all stockpiled as former Obama administration officials.<\/p>\n
We\u2019ve never seen anything like this before, no matter who you talk to, with any experience whatsoever as a lawyer up to whatever level — DOJ, U.S. attorney\u2019s office, federal judge, Supreme Court justice — nobody\u2019s ever seen anything like this. Nobody has ever seen a judge openly thwart the Department of Justice and their desire to not prosecute a case and withdraw it and basically throw it away.<\/p>\n
There\u2019s partisan politics here as well. I\u2019m sure there\u2019s a lot of people fed up that Mueller came up empty. I\u2019m sure there\u2019s a lot of people ticked off that Andrew Weissmann came up empty. I\u2019m sure that there are a lot of people in the Obama administration saying, “My God. We gave these guys unlimited money. We gave \u2019em the media. We gave \u2019em MI5. We gave \u2019em MI6, we gave \u2019em embeds, we gave \u2019em spies, we gave the FBI, we gave Comey everything they needed to nail Trump and they still couldn\u2019t do it.”<\/p>\n
I think they\u2019re still ticked off that they couldn\u2019t do this. You know who the most clean, pure, innocent guy in Washington has to be? Donald Trump. Donald Trump has been anal examed from every angle for three years and they haven\u2019t found diddly-squat. And they are livid. Flynn is the epitome, having Flynn\u2019s case, that was gonna be the big conviction or the big get is having Flynn plead guilty, have Flynn get sentenced, have Flynn go to jail, have Flynn wiped out as a message to anybody else in the Trump orbit, “This could be you.”<\/p>\n
And then William Barr comes along and essentially says, “You guys have no case. There isn\u2019t a case here. There never was a case.” Now everybody knows there was no collusion. The bottom has fallen out of everything Obama set up, including now we know that the director national intelligence Clapper and then Comey and Brennan were all testifying under oath. They never saw a shred of evidence regarding Trump and Russia collusion, despite the fact that they\u2019re lying daily, multiple times a day for two to three years. And that is all known now.<\/p>\n

Now, Debra Katz is the lawyer for this Looney Tunes whistleblower named Rick Bright. So this “ousted vaccine chief testifies in hearing.” The networks are covering it wall-to-wall. It\u2019s nothing more than Trump-Russia collusion. It\u2019s nothing more than Blasey Ford, nothing more than Kavanaugh, nothing more than Trump committed impeachable offenses in a phone call to the president of Ukraine.<\/p>\n
So I think it\u2019s all unraveled, it\u2019s all fallen apart on \u2019em at the worst possible time, leading into the presidential election of 2020. This was gonna be the period of time where Trump was supposed to be frog-marched out of the White House. Plans were that Trump was gonna be found guilty of collusion, whatever. None of what they set up has happened. These are people that think they\u2019re infallible, that they are all powerful.<\/p>\n
Trump tweeted this morning, an hour and a half ago. He said, “If I were a Senator or Congressman, the first person I would call to testify about the biggest political crime and scandal in the history of the USA, by FAR, is former President Obama. He knew EVERYTHING. Do it

You want me to parse this tweet for you? I\u2019ll be happy to. Trump\u2019s getting fed up that Lindsey Graham isn\u2019t doing anything. Lindsey Graham\u2019s going on TV — he\u2019s on Hannity every night or wherever — talking a tough game, making all these promises. Nothing ever happens! Trump\u2019s getting frustrated. You know this Ric Grenell, the acting director of national intelligence?<\/p>\n
Ric Grenell has done more to expose this coup and the cabal of people in it than the Republican Senate has in three years! In three weeks, Ric Grenell…! I\u2019m sorry to be yelling, folks. I\u2019m just trying to relate to you. I know you\u2019re all yelling out there. I know you\u2019re all ticked off. I don\u2019t want you to think I\u2019m not ticked off. I\u2019ve had some people say, “Rush, you gotta be real careful! I know we don\u2019t prosecute ex-presidents, Rush. I know you got beat up for saying that, but you\u2019re right. But you gotta be real careful because Obama is an ex-president, and they are untouchable. You — you — you — you can\u2019t just keep saying that Obama\u2019s responsible for all of this and direct…”<\/p>\n
Why can\u2019t I? You know what? I got a couple of emails along those lines, warning me to be careful about being overall accusatory of Barack Hussein O. So I remembered a story I had read in the 2008 campaign, and actually it was… I knew it was around then when it came out. When I went and looked it up and found it, it actually ran in November 2008, a week after the election.<\/p>\n
It was in the New Yorker, and it was by Ryan Lizza, and it was a postmortem. It was a look back at the campaign, “How Obama Won.” What I remembered about this story was Obama essentially admitting how hands-on he was or is, and let me give you a pull quote from this story. “Obama, who is not without an ego, regarded himself as just as gifted as his top strategists in the art and practice of politics.”<\/p>\n
Quote, “I think that I\u2019m a better speechwriter than my speechwriters. I know more about policies on any particular issue than my policy directors. And I\u2019ll tell you right now that I\u2019m gonna think I\u2019m a better political director than my political director.” So here\u2019s a guy openly admitting that he\u2019s smarter than his advisers, that he doesn\u2019t need them.<\/p>\n
Do you think this is the kind of guy that\u2019s gonna let dozens of underlings run around doing things like this coup without his knowledge, without his input, without his direction? Obamagate is all about politics and particularly the politics of personal destruction. Obama\u2019s ego would not allow him to remain out of the loop with such an operation implemented.<\/p>\n

And the people working for Obama, I guarantee you, would not engage in any of this without his knowledge and approval. And I\u2019ll tell you one other thing. The Comeys and the McCabes, the Clappers and the Brennans and all these people were doing what they were doing to please Obama. Some of them might have been using their own initiative, but it was all to impress Obama.<\/p>\n
Remember, all these people think the guy is a deity, he\u2019s godlike, and he promotes people regarding him that way. So you have a bunch of sycophants here desperate to impress him, desperate to be in the inner circle. They know that he thinks he\u2019s smarter than all of \u2019em, so what they want to do is try to show him how smart they are.<\/p>\n
But the idea that they would go rogue and start a massive coup operation like this on their own is unthinkable. Doesn\u2019t make any sense. They would tell him, because they would want to brag about their efforts. They would tell him, because they would want to brag about their intelligence in being able to put together and implement an operation like this. They would want Obama to be impressed.<\/p>\n
“But, Rush! But, Rush! What about plausible deniability?” You mean you do things so if it blows up, the president is protected because he wasn\u2019t told? Not relevant here. They never thought this was gonna blow up. These people didn\u2019t go into this thinking that it was gonna work. They went into this… They were thrilled, they were excited, they were self-impressed.<\/p>\n
They thought that they would get rid of Trump before he was inaugurated, folks. They thought they were gonna get rid of Trump during the transition — well, hell, they thought they were get rid of Trump before the election. He confounded that by winning. So during the transition, they think they\u2019re gonna be able to create enough doubt that the Republicans or somebody would say, “You know what? Maybe this guy is not fit for office,” whatever.<\/p>\n
They were dreaming — and then when that failed, here comes the January 5th meeting in the Oval Office with Obama, one last-ditch effort to try to damage Trump within the realm of public opinion before he\u2019s inaugurated by plotting how they can get the Steele dossier into the news, into the public domain. That meeting happened on January 5th in the Obama Oval Office.<\/p>\n

And then of course you add the unmasking of Flynn to all this and the numbers of Obama people who wanted to know who he was. You know, there\u2019s something really curious about this, too. The conversation that Flynn had with the Soviet ambassador who goes to lunch all the time, Sergey Kislyak? That conversation that was wiretapped was on December 29th.<\/p>\n
Now, there may have been more than one conversation. But if you look at the dates of many of the unmasking requests, you\u2019ll find that they are December 15th, 16th, 17th, 14th. Well, what the hell? There wasn\u2019t anything to unmask then. There were people that we\u2019ve never heard of that supposedly were requesting Flynn to be unmasked in these conversations with the Russian.<\/p>\n
My point is, there was a plan in motion designed to get Flynn and get him out of the way long before any phone call he had with any Russian that supposedly sent up alarm bells and red flags. None of this happened as they want you to believe it. This was a targeted operation that had been implemented months before December of 2016.<\/p>\n

CALLER: In reference to the judge in the Flynn case, how does a person in the judicial branch of government ignore decisions from the executive branch when it comes to dropping the Flynn case and appoint a former federal judge to, in essence, be a prosecutor, and that person has no affiliation with the executive branch? How is this not a separation-of-powers issue?<\/p>\n
RUSH: It is, and he\u2019s gonna do it until somebody tells him he can\u2019t, \u2019til somebody stops him or thwarts him. In fact, the Supreme Court ruled unanimously just last week against the improper use of amicus briefs. Now, unfortunately the Supreme Court\u2019s list of examples did not include cases like this where prosecutors simply drop the case.<\/p>\n
But the majority opinion, unanimous, written by Ruth “Buzzi” Ginsburg made plain your exact point. The executive branch rules and dominates here, and all of this amicus stuff, bring in amici, friends of the court, to thwart and turn judges into activists is unconstitutional and not to be permitted — and this judge is gonna do it anyway until somebody makes him stop.<\/p>\n
This is a political move, it\u2019s not judicial — and you\u2019re absolutely right.<\/p>\n
He\u2019s bringing in somebody that\u2019s already biased, has already judged the outcome of the case \u2019cause he wrote a Washington Post op-ed about this. This is why Judge Sullivan chose this clown. His name is Gleeson. And what\u2019s gonna happen here is two things. He\u2019s either going to try to play this out as long as he can and delay the adjudication of this hoping that Trump loses so that a Democrat wins the White House, gets a new attorney general, and then reactivates the Flynn case.<\/p>\n

Or he\u2019s gonna go ahead and sentence Flynn to serve jail time on the basis that Flynn has pled guilty and that he\u2019s not gonna let the Department of Justice throw the case away or drop it. The purpose of that would be to force a presidential pardon. And I think both of these possibilities are active. I think Judge Sullivan is clearly an activist judge. These people, we have no idea why they despise this guy, Flynn. And the Obama people despise this guy.<\/p>\n
There\u2019s something behind this that we don\u2019t know yet. The reasons for destroying this guy, it\u2019s gotta be something that he knows or might talk about. They are clearly trying to intimidate this guy into whatever happens with his case to never saying a word about it again. They are purposely not letting him up for air. They are continuing to smother this guy, to frighten, to scare, to threaten, to intimidate however they can. And you know what?<\/p>\n
I think the sooner we get to where Trump just announces a pardon, be done with it. And then go after the judge within the parameters of the law if that\u2019s what\u2019s called for here. But go ahead and announce a pardon and end this. ‘Cause that\u2019s where this is headed anyway. I\u2019ll guaran-damn-tee you, if they sentence Flynn based on his guilty plea, which was coerced. His guilty plea was made to stop the destruction of his family and his son.<\/p>\n
He pled guilty falling on a sword, in other words. He did not plead guilty because he did anything, because he didn\u2019t. He did not lie to the FBI. You know what? It may be useful for me to tell you how this all began with Flynn. I can do it very briefly, because I\u2019m a master communicator. So I will do that when we get back from the break. Don\u2019t go away.<\/p>\n
BREAK TRANSCRIPT<\/p>\n
RUSH: So the FBI has Michael Flynn in their sights and they\u2019ve gotta get rid of him. We now know because of documents that have been released that they were chatting among themselves about what their objective with Flynn was. Do we want to get him fired? Do we want him caught in a perjury trap where we prosecute him? What is our objective here? These were questions going back and forth. And it was decided that they would try to get him fired, try to get rid of him.<\/p>\n
So he is completely unaware of any of these plans. As far as Michael Flynn\u2019s concerned, he\u2019s the national security adviser, Trump is the president, and the FBI\u2019s on their side. The FBI and law enforcement, DOJ all under the executive branch umbrella, we\u2019re all on the same team, we\u2019re out after the same bad guys. Flynn has no idea that he\u2019s being targeted.<\/p>\n
So James Comey, who has bragged about this to Nicolle Wallace on MSNBC, said he decided to send a couple agents to the White House to conduct a criminal interview with Flynn, but not tell him that that\u2019s what was happening. So they sent Peter Strzok and another agent to go just have a conversation, and they ran into Flynn in the hallway in the West Wing. And they just started talking to him about things. And Flynn had no idea.<\/p>\n

They did not tell him it was an official interview. They did not tell him that he needed a lawyer. They started asking him about his conversation with the Russian ambassador, which was totally unnecessary. That conversation had happened on December 29th and they had the transcript of it. They had already unmasked Flynn. They knew everything he said to the Russian ambassador. And yet they\u2019re asking him about the conversation anyway hoping that he says something that\u2019s different than what\u2019s on the transcript. So then they can say, “he\u2019s lying to us.”<\/p>\n
They set him up. And even in those circumstances when this interview was over, even Strzok went to the FBI, “I don\u2019t think the guy lied to us.” But even though the interviewing agents said that they didn\u2019t think Flynn lied, since the purpose was to get him in a perjury trap, they told him that he did. They accused him of lying to the agents.<\/p>\n
Comey was asked about this. He said (paraphrasing), “Well, you know, we were only able to do it because it was a new administration and they\u2019re not sophisticated in how these things work. Had it been the Obama administration, the Bush administration, I would have never even tried this. I would have never gotten away with it. But this administration didn\u2019t know enough to tell my agents that they had to go arrange a chat with Flynn with the White House counsel. This administration was new. They didn\u2019t know how things operated.”<\/p>\n
More importantly, the administration had no idea that the FBI was working to get rid of Flynn and to get rid of Trump. They knew there was some Russian investigation going on, but the FBI had been lying to Trump for weeks about the fact that he wasn\u2019t a target. So Flynn was not told he needed a lawyer. He was denied due process. He wasn\u2019t even told he was being criminally interviewed. He was asked questions about a conversation that the FBI agents already had a transcript for. There was no reason to ask him about this unless they\u2019re trying to set up a process crime of perjury, which is exactly what happened.<\/p>\n
This is what Flynn pled guilty to, lying to these two agents that were part of a setup. And even after the interview, they admitted they didn\u2019t think Flynn had lied. Judge Sullivan knows all this. Everybody in this case knows what an abject miscarriage of justice and malpractice on the part of the FBI and the DOJ regarding Flynn this was. And they are still trying to railroad the guy. And what I told you is among the many reasons that the attorney general has dropped the case. There is no predicate. There was no Trump-Russia collusion. Flynn hadn\u2019t done anything. He did not give away American secrets talking to the Russian ambassador. He did not attempt to undermine Obama\u2019s so-called sanctions that he had placed on Russia in December of 2016.<\/p>\n

This was entirely set up and manufactured. Barr finds out about it as part of Durham investigation — he knew it before then — throws the case out on the basis that there isn\u2019t a case. They have never had a case against Flynn. “But, Rush, but, Rush, he pled guilty.” After wiping him out, folks, after taking away his home in legal fees. After having his son be threatened with the same kind of treatment. He pled guilty to save his family. He pled guilty to fall on the sword. Judge Sullivan knows this too. Judge Sullivan knows all this.<\/p>\n
And, by the way, this is the CliffsNotes version. I\u2019m giving you the essence of it because I have the talent and the ability of a master communicator. Most people, it would take \u2019em 30 minutes to tell you what I just squeezed in here in a matter of five minutes. This is how outrageous this is, with Comey on television bragging about how easy it was to stet Flynn up because this new administration was a bunch of neophyte, unsophisticated boogers. They hadn\u2019t the slightest idea what was going on. They were so easy to set up. They were so easy to fool. They were so easy to lie to.
