CALLER: How are you today?<\/p>\n

RUSH: Fine. Thank you.<\/p>\n

CALLER: I — I must tell you that I have never really liked you, but I listen to you sometimes just to get another opinion. And I kind of agree with you on the thing with the new appointee for the Supreme Court, even though I\u2019m a Democrat.<\/p>\n

RUSH: Yes, ma\u2019am?<\/p>\n

CALLER: Because I don\u2019t — ahem. I don\u2019t know whether the lady is a racist or not, but people that are going to sit on the Supreme Court of the United States must have control of their tongue. Because they represent the people of this country. They are the defenders of the Constitution and the people of this country.<\/p>\n

RUSH: See, now, that\u2019s a brilliant point, Linda, and a brilliant observation. But that\u2019s not why President Obama wants Sonia Sotomayor on the Supreme Court. He\u2019s not looking at someone to defend the Constitution. He is constrained by it. He wants somebody who will do his bidding there, and that is deconstruct it.<\/p>\n

CALLER: But you see it — not to interrupt you, but it doesn\u2019t matter because the president of the United States is supposed to defend the Constitution. That\u2019s what he says when he gets elected.<\/p>\n

RUSH: Well, yeah. I know. I mean, there\u2019s —<\/p>\n

CALLER: So —<\/p>\n

RUSH: — a word for that. Sonia Sotomayor, if what she has said and how she\u2019s ruled in previous cases would do that way on the Supreme Court, then she would be denying her oath of office. There\u2019s a word that would probably offend columnists and Republicans if I used it, and that\u2019s ‘liar.\u2019 So I didn\u2019t use it, okay?<\/p>\n

BREAK TRANSCRIPT<\/p>\n

RUSH: One more thing on Judge Sotomayor here. You know, the racist thing that she said, the bigoted thing that she said it\u2019s pretty sexy and it offers a pretty rich target, but let\u2019s not forget the other thing. While a judge, while a sitting judge on the Second Circuit Court of Appeals, she said, ‘It is the job of appellate courts to make policy.\u2019 That is why Obama chose her. Our last call from North Carolina, the Democrat who doesn\u2019t like the choice because she thinks that Sotomayor is not going to pay attention to the Constitution is exactly right. You\u2019ve heard Obama; we\u2019ve played you the sound bites. The Constitution doesn\u2019t do enough for him. ‘The Constitution is a charter of negative rights.\u2019 It lays out all the things government can\u2019t do to you but it doesn\u2019t specify what government can do for you. <\/p>\n

Meaning it doesn\u2019t talk about redistribution of wealth. The Constitution is full of things the government does for us, like protect us, provide for the general welfare, and on and on and on. Here\u2019s a woman who has admitted that her job as a judge is to make policy. That is just as good a reason to disqualify her, \u2019cause she\u2019s admitting that she\u2019s going to look for ways around the Constitution, and she says she can find them better than white people because of the rich life she\u2019s led as a Latina. Well, you can cringe when I say it, but somehow it\u2019s no big deal when she does. And now back to the phones.
