RUSH: Now Andy McCarthy column today: “Mueller\u2019s Political Indictment.<\/a>” This is a great piece that rips to shreds Mueller\u2019s indictment on Friday, what it really means. But I want to share with you just a couple of things here. The opening line: “So is Russia now presumed innocent of hacking the 2016 election?” Now, anybody reading that who only knows how the indictments are reported, says, “Whoa, whoa, whoa, whoa.<\/p>\n

“Wait a minute! Wait a minute! I read that indictment. They didn\u2019t say Russia\u2019s innocent. They said Russia hacked.” A-ha. Yes. And you\u2019ve been nabbed. Hang on. “So, is Russia now presumed innocent of hacking the 2016 election? If not, it is difficult to understand any proper purpose served by Special Counsel Robert Mueller\u2019s indictment of twelve military officers in the Kremlin\u2019s intelligence services for doing what everybody in America already knew that they did, and has known since before Donald Trump took office \u2014 indeed, since before the 2016 election…<\/p>\n

\"\"“Oh, and by the way, the answer to the question posed above is, ‘Yes, it is now the official position of the United States that Russia gets our Constitution\u2019s benefit of the doubt.\u2019 Here is Deputy Attorney General Rod Rosenstein announcing the Friday the 13th indictment: ‘In our justice system, everyone who is charged with a crime is presumed innocent unless proven guilty.'” Rosenstein was saying these Russians are innocent until we prove it. Well, guess what? We\u2019re not gonna prove it because there isn\u2019t gonna be a trial, because these Russians are never gonna get served.<\/p>\n

And if they are as he needed, they\u2019re not gonna be extradited, and Mueller knows it! Just like he thought the Russian troll farms would never show up in court when one of them did! That\u2019s another no-no today. Putin started talking about Concord Management. You\u2019re not supposed to embarrassing Mueller by pointing out that one of the people he charged showed up and pled not guilty, demanding to see the evidence, and Mueller doesn\u2019t have any, so he won\u2019t produce it. You\u2019re not supposed to bring that up, and Putin did.<\/p>\n

And Trump didn\u2019t push back on it. What a bad guy Trump is. And of course the Russians are never gonna be proven guilty. Not in a courtroom, since Rosenstein was invoking!<\/p>\n

“As is so often the case in today\u2019s politicized Justice Department, Rosenstein was trying to make a different political point.” Are you ready? “If people whom we have formally charged are presumed innocent, then, a fortiori, people who have not been accused \u2014 implicitly, Rosenstein was talking about President Trump \u2014 must also be presumed innocent. But, see, you can\u2019t make that point without stepping on the political purpose of Friday\u2019s charade.”<\/p>\n

But it\u2019s true. If Russia is presumed innocent, if they\u2019re gonna be given our constitutional protections, they\u2019re presumed innocent \u2019til we prove they\u2019re guilty, and they\u2019ll never be proved guilty because there will never be a trial, then if the people charged are presumed innocent, then people not named have to be presumed innocent, and Trump was not named. So Trump has to be presumed innocent in Mueller\u2019s indictment.<\/p>\n

“Rosenstein made another telling remark at his big press conference. The Justice Department, he explained, will now ‘transition responsibility for this case to our Department\u2019s National Security Division while we await the apprehension of the defendants.'” Well, chuckle, chuckle, there isn\u2019t going to be any apprehension of the defendants.<\/p>\n

“But Mueller\u2019s case –” now, stop and think about this, “– Mueller\u2019s case, the definitive case about what Russia did to interfere in the 2016 election, is no longer Mueller\u2019s case.” He\u2019s transferring it back to the Justice Department, and they\u2019re gonna put it in some division. They\u2019re gonna bury it. They\u2019re gonna bury this in the national security division that deals with counterintelligence matters. And there are never public trials in counterintelligence measures. That\u2019s been the point of this from the get-go.<\/p>\n

This has never been a criminal investigation. These indictments are not criminal because Rosenstein said that these indictments are gonna be transferred to the national security division, and the national security division deals with counterintelligence. And so this case is gone! It\u2019s been sent over to the DOJ where it\u2019s gonna be buried. It\u2019s not even gonna be pursued as a criminal matter, making these indictments purely PR buzz and political. Purely. The case isn\u2019t even gonna be pursued!<\/p>\n

So now Mueller “woven an indictment that can never be tried out of counterintelligence work against foreign governments that is not supposed to be the subject of criminal prosecution.” The subject of public courtroom testing under due process rules is not gonna happen here because it\u2019s gone to the counterintel division where it is gonna get buried.<\/p>\n

It is also practically an admission that this case never was a case. There was not a crime specified when Mueller was put in charge. He wasn\u2019t given a specific crime to investigate, so it\u2019s been a fishing expedition, and all of that, with all that time, all that money, they got nothing. They got A total 26 Russian names, trolls and hackers, none of which will ever see the inside all of courtroom, none of which will ever be found guilty of anything.<\/p>\n

Yet we\u2019re supposed to sit here and all agree that the Russians tampered with the 2016 election without a damn shred of evidence anywhere. We\u2019re just supposed to assume it. And Trump is supposed to admit it! He\u2019s supposed to be a big guy and at a press conference with Putin, he\u2019s supposed to admit that this happened. He\u2019s supposed to defend the intelligence community trying to destroy him even to this day.<\/p>\n

When all Donald Trump knows is he won the election by outworking everybody. He was clever, more creative, he worked harder than anybody, he inspired more people than Hillary Clinton will in her entire life and afterlife. Why should he admit, why should he take one even half step toward admitting that his presidency, his victory is tainted, tarnished, or even illegitimate? That is a gigantic trap set for him, and he has successfully avoided stepping in it. And they\u2019re ticked off that they\u2019re not able to outsmart the guy.<\/p>\n","protected":false},"excerpt":{"rendered":"
