RUSH: Folks, you remember the special counsel, Robert Mueller, indicting 13 Russian firms and entities in Russia? Concord Management is one of them. He\u2019s indicting these people for tampering in the election by monkeying around and messing around with the internet, internet trolls, they were called. Thirteen different entities, and people were indicted. And at the time, I made the point as did many others that these were nothing more than public relations indictments because these clients, these accused would never, ever show up in court, their cases would never be tried.<\/p>\n

Mueller figured on that, he counted on that. This was simply a way to spin that he had found evidence of Russian collusion in the election by indicting these internet trolls — who, by the way, spent most of their money on the internet buying ads after Trump was elected. And then remember what happened, one of these 13 internet trolls, Concord Management said, “Wait a minute. We didn\u2019t do this.”<\/p>\n

And they went out, they hired an American law firm, and the American law firm showed up in court and pled “not guilty” and demanded to see the evidence that Mueller had. Well, the odds are Mueller doesn\u2019t have any evidence. The indictments were just for show. There was no way these people, in Mueller\u2019s view, were ever going to answer and show up, and that was what he was counting on. So here he gets indictments that were gonna go a long way to appearing as though the clients and perps are guilty because they\u2019re not even gonna show up.<\/p>\n

Then these people throw a wrench into the works and hire an American law firm and demand to see the evidence. Now, this is three weeks ago. At the time this happened, I got the biggest kick out of it because I said<\/a>, “This is gonna force Mueller\u2019s hand because he doesn\u2019t have any evidence to produce. ‘Cause these guys didn\u2019t actually do anything. This is nothing more than a spin PR move.”<\/p>\n

Well, these lawyers have persisted. The lawyers for Concord Management, one of the Russian trolls, internet trolls, are demanding to see the evidence. And here\u2019s the latest news on this. Well, you know, what I used to print eliminates the link or maybe I did, so I\u2019m not sure where this comes from. It\u2019s a mainstream site. It might be the Washington Post. The writer is Colin Kalmbacher. I just can\u2019t remember where this is from. But it\u2019s not fringe, okay?<\/p>\n

Headline: “Mueller is Trying to Keep Evidence from Defendants in Russian Trolls Case<\/a> — Special counsel Robert Mueller and his deputy Rush Atkinson filed a 14-page motion Tuesday arguing that the government shouldn\u2019t have to release certain evidence to indicted Russian company Concord Management and Consulting LLC due to ongoing ‘interference operations\u2019 against the United States.”<\/p>\n

So Mueller — we wondered how he was gonna deal with this. Some people thought he would have to vacate the indictment because, folks, you can say this with all of the things, but if there\u2019s one thing about the American judicial system that is sacrosanct, when you\u2019re charged, you have the full right to see what you\u2019re charged with and who is saying what about you. The prosecution is required to answer those questions for you. The prosecution, the government in this case, is required to tell you what you did! They are required to show you evidence and especially if there\u2019s any exculpatory evidence.<\/p>\n

Now, Mueller\u2019s team, as a side issue here, Mueller\u2019s team has a bunch of lawyers on it who have flouted that aspect of the law. A lot of them come from the Enron task force. A lot of them come from the Ted Stevens case. Ted Stevens, Senator, Alaska, was convicted and lost his Senate seat while the prosecution held evidence showing he was not guilty. They withheld the evidence. The judge blew up at these lawyers. Similar types of lawyers are now on Mueller\u2019s team.<\/p>\n

It\u2019s a bedrock that you must be shown what the government has. You have to be able to provide and prepare a defense. And Mueller is attempting to get out of having to provide the evidence to this firm! And his excuse is, “Well, they\u2019re still meddling. I can\u2019t give you the evidence because they\u2019re still meddling.” So Mueller is doubling down. This firm, which has pled not guilty, Mueller and his team are now saying, “We can\u2019t give \u2019em the evidence we\u2019ve charged \u2019em with because they\u2019re still trying to manipulate American elections.” This is outrageous!<\/p>\n

These people have corrupted the reputation and the image, the integrity of our electoral system as it is, and now they come out and say that one of these internet troll farms is still meddling in — what, did they have something to do with the Sanford loss, Mr. Mueller? What are you gonna allege here? They\u2019re still interfering? And that\u2019s why you can\u2019t provide evidence? This is in violation of a bedrock principle of the American judicial system.<\/p>\n

Mueller\u2019s team told the judge — they requested a protective order to keep other codefendants named in the indictment from accessing the government\u2019s evidence against them and to keep additional evidence under the control of Mueller and his lawyers away from Concord Management itself. Mueller\u2019s team is suggesting that Concord Management not have access to the evidence being used against them for now. Mueller contends that only Concord Management\u2019s attorneys be given access to said evidence, maybe. And if so, way down the line in the future.<\/p>\n

With the court\u2019s permission, two additional legal teams, one provided by the defense, one provided by the government, might huddle together and come to an agreement that Concord Management actually be afforded an opportunity to view the evidence in question but not actually possess it.<\/p>\n

Now, the Supreme Court has spoken on this countless times, as have lower court judges. The rights of the accused to know what they\u2019re up against is a bedrock. And here\u2019s Mueller trying — and I\u2019ll tell you what: He doesn\u2019t have anything on them, folks, and he doesn\u2019t want to vacate the indictment, \u2019cause that would be horrible PR.<\/p>\n

So they are improvising: Well, these malcontents, these ne\u2019er-do-wells from Russia, these friends of Putin, they\u2019re still meddling, Judge. I can\u2019t be forced to give them the evidence here. We\u2019ve gotta convict these SOBs, and they\u2019re still trying to cheat our great country. I\u2019m not handing it over.” The criminal justice system here is being really bastardized, folks.<\/p>\n

BREAK TRANSCRIPT<\/p>\n

RUSH: Can you imagine a United States attorney prosecuting a Mafia case, can you imagine the lawyer saying, “Judge, I\u2019m sorry. I cannot disclose the evidence to Mr. Gotti because, guess what? He\u2019s still doing it. He\u2019s still doing it, Judge. I can\u2019t let him know what we\u2019ve caught him doing because he\u2019s still doing it!” The judge would laugh the lawyer out of court!\"\"<\/p>\n

Well, Bruce Cutler, yeah, but that\u2019s for a different reason. Cutler ended up, he got too close to it. Cutler — I worried that it was — (interruption) Yeah, but that\u2019s not what we\u2019re talking about here. We\u2019re talking about the prosecution, not the defense. Mueller actually telling the judge, “I can\u2019t give the defendants the evidence, judge. They\u2019re still meddling in our elections.”<\/p>\n

The answer is, as my buddy Andy McCarthy says, you don\u2019t go to trial until you\u2019re ready to go to trial. You don\u2019t go down this road unless you\u2019re ready to go down this road. Mueller never expected to have to go down this road because he never thought these Russians would answer his indictment. He never thought he was gonna have to try this case. He never intended for these cases to see the light of day.<\/p>\n

This was nothing more than a series of indictments that were for public consumption and for the media to spread lies about. “Hey, look at this. Mueller has actually some collusion, he\u2019s indicted some Russians, and the Russians are so guilty, they\u2019re not even gonna show up and defend themselves.”<\/p>\n

Well, one of them did and bollixed up the whole operation. So now Mueller and his team have to get creative and come up with flimsy excuses to not hand over the evidence, because they don\u2019t have much, if any at all.<\/p>\n
