CALLER: Hi, Rush. First-time caller, long time listener. Just want to tell you how much I love you.<\/p>\n

RUSH: Thank you very much.<\/p>\n

CALLER: Anyway, I wanted to ask you, is anybody suing President Obama for not following through on this legislation?<\/p>\n

RUSH: You know, that is a fascinating question. Constitutionally, Obama can\u2019t do this.<\/p>\n

CALLER: Yes.<\/p>\n

<\/p>\n

RUSH: The legislation is the legislation. He cannot write legislation.<\/p>\n

CALLER: Yes.<\/p>\n

RUSH: He cannot unilaterally change legislation. He is not a dictator. This is not an imperial presidency, although he\u2019s acting like it.<\/p>\n

CALLER: Uh-huh.<\/p>\n

RUSH: But if nobody is gonna hold him accountable for these kinds of things — he can\u2019t do all of this. He can\u2019t grant these waivers.<\/a> He can\u2019t do all these exemptions. He can\u2019t just decide, “I\u2019m going to delay that part of the bill that I signed into law.” He cannot write legislation, other than during the process, of course, he has a liaison with Congress and they might work, but after it\u2019s signed into law, he can\u2019t go in and change it. This is not how this happens. This is extraconstitutional, meaning outside the Constitution. It\u2019s the law of the land now. He just can\u2019t decide willy-nilly when it is and when it isn\u2019t.<\/p>\n

CALLER: Uh-huh.<\/p>\n

RUSH: So what we have here is another change in Obamacare, which we\u2019re told is now the law, and therefore can\u2019t be changed, we\u2019re told we can\u2019t repeal it. Obama himself said, “We can\u2019t repeal it,” and the Republicans don\u2019t want anybody to have health care and all those lies that he tells. We can\u2019t repeal it \u2019cause it\u2019s the law of the land. Well, he is. He is in effect repealing or delaying parts of it that are harmful to him politically. Can\u2019t do this. Suing him? Somebody should. You let a Republican president try to do this, change legislation to benefit him at the next election. You wait and see how far he\u2019d get.<\/p>\n

BREAK TRANSCRIPT<\/p>\n

RUSH: One other thing to this, folks. This move today of delaying this whole business on the caps, out-of-pocket caps, expenses and so forth, this is going to really increase the profitability of insurance companies, for just this next year. The insurance companies are gonna be paying out far less. Their profits are gonna skyrocket. Now, I expect it will not be long until a bunch of far left extremist kook networks and websites figure this out, and they are going to start screaming bloody murder, and Obama knows this. <\/p>\n

The thing about this, when I first learned of this today, that was the main point that confused me, because what Obama is doing here, make no mistake, he is delaying this implementation of consumer cost protections. Stop and think of that for just a second, now. In relationship to the elections in 2014, the Democrats want to win the House, hold the Senate, of course, he is delaying consumer cost protections. He is increasing insurance company profits. Why? How in the world is that going to help the Democrats? That\u2019s gonna anger a lot of people. <\/p>\n

<\/a><\/p>\n

Well, there\u2019s a bunch of things at play. I really don\u2019t think there are too many consumers who know the nuts-and-bolts details of how it is they are going to save money. They just think they are. Start talking to them about caps on out-of-pocket expenses, I mean, they might actually understand that in more numbers than I think. But on one hand, insurance company profits skyrocket, consumer cost protections delayed to help Obama and the Democrats in 2014. How does that work? There must be something worse. What\u2019s worse than this? <\/p>\n

What\u2019s the other side? The other side is if this is not delayed, everybody\u2019s premiums are going to skyrocket. And it is clear to me that Obama has made his own cost benefit analysis, and the Democrats have decided that there is less damage to their electoral chances by delaying all this and making sure that insurance premiums don\u2019t skyrocket than the other way. So insurance company profits are going to be much higher this year when the left wing, all the pajama clad bloggers and the anonymous lunatics that post comments to their websites and the dummkopfs at MSNBC, I mean, profit is like showing Dracula the cross. Insurance companies are among the most hated of all capitalistic entities on the left. <\/p>\n

So you combine increased profit for the hated insurance companies, and you are gonna have a bunch of really ticked off leftists. Then you tell them that the insurance company profits are gonna skyrocket because consumer cost protections are being delayed, you\u2019ve gotta recipe here for genuine anger and disgust on the left. But on the other side of it, skyrocketing premiums for everybody. And they\u2019ve obviously made the judgment that not delaying this presents them less of an obstacle than delaying it. <\/p>\n

Now, go back to our last caller. Legally this can\u2019t be done. I\u2019m alarmed at how many people simply sit here and accept it. “Oh, gonna delay that? Okay, fine.” The president cannot do this. Our Constitution does not permit the president of the United States to willy-nilly decide what parts of a law he\u2019s gonna employ or implement and not. This is not legal, what Obama is doing and has done on three major previous occasions where this law is concerned. And while that\u2019s happening, the Republicans, some of them, are making noise about repealing it by way of not funding it in the next continuing resolution fight at the end of September. And the Democrats say, “You can\u2019t do that. It\u2019s the law of land. You can\u2019t tamper with it like that.” Obama\u2019s even saying that, “You can\u2019t cancel a law. It\u2019s the law of the land. You can\u2019t defund it.” <\/p>\n

Why not? The president can decide the parts that hurt him politically are not gonna be implemented right now, can delay \u2019em. This is banana republic kind of stuff, folks, it really is. But if there is nobody in the opposition that\u2019s gonna push back against it, then guess who it\u2019s gonna be left up to again? You, the grassroots, or as Joycelyn Elders would say, “The grassruts.” It\u2019s gonna be up to you to raise hell about this. But this is a dramatic violation of the Constitution. <\/line><\/p>\n

Obama has already delayed more than one-third of the deadlines in Obamacare, and for a host of reasons. A, they can\u2019t meet them. B, it would be too damaging politically. And the media runs around, “Well, Obama, he\u2019s only doing it for the people. He\u2019s only doing it for everybody\u2019s benefit. There\u2019s nothing really to see here.” You let any Republican president try this. You let a Republican president say, “I\u2019m gonna delay that increase in food stamps. We can\u2019t afford it right now. I\u2019m just gonna delay that.” There would be smoke and fire and hell to pay, in the Democrat Party and in the media. And this is serious. This is a serious violation of law. This is a serious violation of the Constitution, to do this willy-nilly. And then you add to it Obama\u2019s doing it for his party\u2019s political benefit. That\u2019s the only reason this is being done. <\/p>\n

And then the final point to be made is, here\u2019s this wonderful health care reform law that\u2019s supposed to be just compassionate and finally makes sense and be beneficial for everybody and make it accessible and affordable, it\u2019s so damn good, we can\u2019t dare let it be implemented. Maybe it isn\u2019t so damn good. Maybe it is an absolute disaster, and as long as there is an election out there in the future, we\u2019re gonna delay the disaster until after the election so that you people voting do not have the full scope of information at your disposal to make the decision on how you\u2019re gonna vote. This is what is going on. It is pure, raw partisanship and unconstitutionality. It really is. <\/p>\n

Our last caller had a great question. “Is anybody suing Obama for this?” No. And that\u2019s essentially what it would take, congressional action, a lawsuit, or something, but Congress is just idly standing by letting this happen. He doesn\u2019t write the law, folks. No president does. Presidents do not write the law, no matter what our low-information population thinks. In fact, Obama\u2019s even said so at some of his public appearances where low-information voters have been demanding immediate relief on something. (imitating Obama) “Well, you know, I don\u2019t write the law. I can\u2019t write the law. We have our laws, the Constitution, I can\u2019t write it.” Doesn\u2019t matter. <\/p>\n

You let anybody on the Republican side start talking about defunding, “You can\u2019t do that! It\u2019s the law of land. You can\u2019t take the money away from it.” Well, Obama can certainly take the money away from it. Obama can certainly deny implementation or delay it, or what have you, and nobody raises a peep. And again, a large reason why is the president\u2019s race. It simply strikes fear in the hearts of the opposition. <\/p>\n

CALLER: Hi, Rush. I hope you, Kathryn, and your family of pets are well.<\/p>\n

RUSH: Thank you very much, sir.<\/p>\n

CALLER: My question is, why don\u2019t the Republicans reverse course and instead of defunding Obamacare, fund it. Plus, add the CBO estimate and say we will fund everything, but you have to implement everything January 1st, 2014, and put it on his desk.<\/p>\n

<\/p>\n

RUSH: I think that goes against the message that the Republicans want to send. Some Republicans. Some Republicans want to send the message, whether they succeed or not, that they still profoundly object to this whole thing.<\/p>\n

CALLER: But, you know, sometimes you have to punt, and this time put it on his desk. We will fund it, but you can\u2019t delay nothing.<\/p>\n

RUSH: No, no. It already is funded. See, this is the point. It\u2019s already funded, and it\u2019s supposed to implement now. That is the law. He\u2019s the one changing it. So you want them to write another law confirming the first law that he is violating in order to illustrate that he\u2019s violating the law. His voters aren\u2019t gonna care. I mean, that\u2019s where we are. And he\u2019ll just violate that one. He\u2019ll just sign it and say, “Okay,” and then announce some more delays, until somebody opposes him on it. <\/p>\n

CALLER: You were talking earlier about Obamacare and the insurance companies making a lot of money off — this points right back to your Limbaugh Theorem again. When businesses are forced to lay off employees or cut their hours because of this Obamacare, and insurance companies make more money, as you pointed out, Obama\u2019s gonna point right to that and say, “See, the evil capitalist system has done it again, it\u2019s taking advantage of the small man.”<\/p>\n

RUSH: Yeah.<\/p>\n

CALLER: So health care, what I wanted to shoot at, number one, is health care is not about health care. We have to know who Obama is, and he\u2019s an ACORN lawyer. His whole teaching and philosophy is in social justice. He shoots every single one of his programs through the prism of social justice, how he can move wealth from one group of people to another group of people, and so whether it\u2019s health care or anything else, these student loans or whatever his administration is doing.<\/p>\n

RUSH: It\u2019s a sophisticated form of redistribution — almost theft. You know, you\u2019re right. Obama is about taking other people\u2019s money, because they didn\u2019t come by it in a fair and just way, because it\u2019s capitalism, which is unjust and unfair. And anybody who got their money and their wealth capitalism had to cheat somebody. I guarantee you, folks, we spent the first hour on the delay of the exemption some of these consumer cost protections, insurance company profits, insurance company profits this year, because of the delay, are gonna skyrocket, and they\u2019ll be reported. And Obama will point to them, and he\u2019ll talk about how unfair capitalism is and move to get this system in place even faster. <\/p>\n","protected":false},"excerpt":{"rendered":"
