RUSH: And the Drive-Bys are breathless, ladies and gentlemen. They can barely contain themselves. The Drive-Bys don’t know what to do. They’re all trying to explain it. They’re trying to get to the bottom of it. They’re trying to understand it. And, of course, I, your host, El Rushbo, have the answer. Eric Holder is resigning. And the Drive-Bys, it came up as a total shock. It was unexpected. It was a surprise. Pelosi divulged the details and then NPR had the story.

It doesn’t matter. He’s just gonna be replaced with Al Sharpton or somebody like him. I mean, that’s what the DOJ has been turned into. Eric Holder has subverted the Department of Justice and now it’s no different than if Jesse Jackson or Al Sharpton were running it, and whoever Obama nominates is gonna be Obama Jr. or Obama III in there. The dye’s been cast. I’ll tell you what I think. I don’t think he’s afraid of any Senate investigation. Why would anybody be afraid of the Republicans?

Why would anybody be afraid of what the Republicans are gonna do? They ain’t gonna investigate anybody. They don’t want to anger the voters. They don’t want to show the voters that they’re mean and partisan and all that. No, I think Eric Holder is stepping aside, A, he wants to go back and represent terrorists at his law firm. The prime minister of Iraq — have you heard about this? — has uncovered a terror plot to blow up subways in Paris and in New York, and the prime minister of Iraq says that this terror threat is imminent.


It is breaking news. The prime minister of Iraq has just claimed that there is an ISIS plot to blow up subways in New York and Paris, and he says the plot is imminent and has not, repeat, not been thwarted.

Now, this is terrorism, and supposedly the Iraqi intelligence service just uncovered the plot. But even if it turns out to be a false alarm, this is a win for terrorism. This is what the terrorists want: Make us afraid of our own shadows. I was just watching television here right before the program. It doesn’t matter what channel. I don’t remember which one, but they’re talking about this. And to prove how this is already a win for the terrorists, “Oh, gee, you know, this makes me feel like we did right after 9/11. I don’t like this feeling. We gotta do something about it. We gotta do something about it right now.”

Okay, that’s even if nothing happens. So now new security concerns, measures, what have you, on the subways, which is understandable. This is how this stuff works. So I think Eric Holder is looking at a potentially new client list. And there’s always the cashing-in aspect. After you perform your six years of government service, you then retire to the private sector and get paid off for it. People hire you who are grateful for what you did or you go back to your law firm where you are a rainmaker, don’t even have to do any work.


They put your name on the letterhead, on the door, and you attract clients and get a percentage of what walks in the door. There is any number of ways this can happen. But there’s also another possibility regarding Eric Holder. I just want you to prepare yourself. It may happen. We still have two years to go.

There may be a Supreme Court vacancy, and I can see Barack Obama nominating Eric Holder to fill it, and it would be much easier for Eric Holder to make the jump from private sector law firm rainmaker after six years at DOJ to the Supreme Court, than from DOJ straight to the Supreme Court. I don’t know how much that would matter, but don’t rule any of that out. I don’t think there’s any scandal. I don’t think it’s Fast and Furious. I don’t think he’s worried about the Republicans investigating anything if they win the Senate.

Folks, there’s a story — I’ll get to this in the greater detail moment — a story at TheHill.com today talking about how, if the Republicans win the Senate, it will advance immigration reform. A Republican victory in which they take control of the Senate will result in amnesty, comprehensive immigration reform. TheHill.com. It’s right there. I don’t know if it’s true. I don’t know if it’s a head fake. I don’t know if it’s an attempt to bully and intimidate. I don’t know if it’s consultant leaked and inspired. But it is out there.

BREAK TRANSCRIPT

RUSH: We start in Frederick, Maryland. Hi, Donna. Your first, and that’s an awesome responsibility for the first caller every day to establish the tone and establish momentum. Are you up to it?

CALLER: Yes, sir, I certainly am.

RUSH: Right on! Rock on!

CALLER: I’d like to comment with respect to Eric Holder. I was so intrigued by what you said with respect to the Supreme Court in the future. So my follow-up question to that is: Who do you think Eric Holder’s replacement as attorney general?


RUSH: I don’t know ’cause this only happened this morning, and I’m not being facetious, and I’m not trying to be flippant. I don’t think it matters. Obama’s gonna find an exact clone attitudinally, ideologically, policy-wise. He’s gonna find somebody that… He just needs himself. He needs to find a lawyer that is Obama who can get confirmed.

It may even better if he doesn’t get confirmed, just that the ongoing — ’cause Holder’s not leaving until the replacement’s confirmed. So I have no idea. I don’t even know right now who would be on the short list, Donna, ’cause I just haven’t had time to dig into this, this happened so close to the program beginning today. Why…? I mean, nobody knows why he’s stepping down.

I’ve got people asking me left and right, and the Drive-Bys are speculating, ’cause it came out of the blue. Now, he’s been there longer than most cabinet officers stay. Most cabinet officers burn out after one term and leave either after a first term of a two-term presidency or shortly after the second term begins. But this just came out of the clear blue today, and so I think people are gonna be starting to put together lists of people.

But Obama’s not gonna have any trouble finding a radical. That’s who he knows. That’s who his buddies are. It could be somebody already there. It could be Thomas Perez, who is (chuckles) Eric Holder multiplied, and he’s over Department of Labor right now. So it could be any number of people. They’ll look at confirmation, I would think, and what would be the least problematic confirmation process.

If they’ve got somebody that’s already been confirmed to something somewhere else, that could be it. Remember, now, this is just gonna be for a year and a half, but more than a placeholder. I kid you not: Claire McCaskill has been mentioned, which would be a loyalty appointment. I’m not kidding. I hope you’re not driving to St. Louis and pulling off on the side of the road having a wreck here when you hear that, but it’s a name that I have heard so far today being bandied about.

RUSH: I was making a joke earlier. And when I make jokes, they come true. Get this. Al Sharpton said that he is engaged in immediate conversations with the White House as they work to name a successor to Eric Holder. I was making a joke that the next attorney general would be Sharpton or somebody. And Sharpton says that he is involved in intimate conversations at the White House to find the new attorney general. RUSH: Here’s Richard in Myrtle Beach. Richard, thank you for calling, sir. You’re next. Hello.

CALLER: Thank you. Always a pleasure. Listen, I question the timing of this Eric Holder resignation. They won’t find a replacement for him before Election Day. I think that he’s gonna go on a little tour to galvanize the black and minority vote, and he won’t be held to any kind of standard because there can’t be any repercussions because he’s already resigned. So you can’t ask for his resignation.

RUSH: This is —

CALLER: But I believe that it’s gonna be inflammatory. I believe that we’re going to understand that one of the reasons he’s stepping down is — I heard this last night — there’s a great inequity in the judicial system, in the court system, how we treat blacks compared to whites. I know there’s a statistic that stipulates that the majority of violent and most crime is like 70% is African-American. Now, I can’t be quoted on that, but I believe they’re gonna use this as an opportunity to really make race a divisive issue in this country.

RUSH: That is an interesting thought.

CALLER: They do everything that way.

CALLER: Go ahead.

RUSH: No, they do have to gin up turnout. The Congressional Black Caucasians, we played audio sound bites today of John Lewis and some others.

CALLER: Yeah.

RUSH: They’re already talking about how we’re gonna be back in the days of slavery if we don’t win this election in November.

CALLER: Well, I like your theory about him going to the Supreme Court.

RUSH: I think that’s —

CALLER: I hadn’t heard that.

RUSH: That’s one of the things I thought of. Nobody’s gonna do anything to him. There isn’t gonna be any investigation of Eric Holder. Now, there may be a health thing that nobody knows about. Who knows? But it just caught everybody flat-footed and totally by surprise. My first theory was that he’s getting himself out of DOJ so that he can be selected as the next Supreme Court nominee.

Now, here’s one thing: If that turns out to be accurate, Richard, then it kind of dongs your theory a little bit, because if he… Well, I don’t know. I like your theory, too. He’s already resigned and is just waiting to be replaced. It won’t be before the election. So he can go out and raise hell, vote turnout and all kinds of things, and what can anybody do? He’s already gone; there nothing we can do.

We can’t impeach, sanction, ’cause he’s already resigned. But if he does that in as blatant a way as you describe, it might be problematic for future confirmation to the Supreme Court. Might not, either. It depends on who’s doing the confirming, meaning who runs the Senate. (interruption) I know they were nice to him. Don’t make me relive this. (interruption) I can’t… (interruption)

Nobody can, because that was the beginning of the kiss — uh, the suck-up. You know, shortly after the election, Obama names Holder as the attorney general and Republican after Republican after Republican — one conservative think tank and judicial expert after another — said, “Oh, what a great choice! Why, this is an enlightened,” and I’m watching this in stunned disbelief.

That’s when I realized why everybody got so mad at me when I said, “I hope he fails,” because the exact opposite was going on. Everybody, everybody was sucking up to try to show that they were not racist and… Ah, it was just… (interruption) Yes, he’s the guy that got the Marc Rich pardon. He represented Marc Rich. Anyway, Richard, that’s an interesting theory, and because of it, we will keep a sharp eye. It’s gonna be interesting to see. He could do that on the sly, too, without nobody knowing. We will see.
